Definitions

1. “Candidate Profile” is the profile of a Candidate on our Website
2. “Client” any person, firm or company who approaches the us with a view to Engaging or otherwise employing a Candidate, or any person, firm or company to who approaches us with a view to advertising a vacancy.
3. “Employment Recruitment Services”: we offer a service whereby the Client can upload job postings to our Website and can view and download Candidate Profiles
4. “Party” us, you and the Client, and Party will mean either one of them
5. “We, Us or Our” is a reference to Pick of the People Limited a company registered in England and Wales under company registration number 10591856, and whose registered office is at Unit 24 Ddole enterprise park, Llandrindod Wells, Powys, LD16DF and we operate and own this website (“the Website”)
6. “You or your or the Candidate” is a reference to a person introduced by us to the Client;


Terms and Conditions

1. By accessing the Website you are accepting these Terms and Conditions and our Privacy Policy

2. Below are the terms and conditions on which we provide the Employment Recruitment Services. We reserve the right at any time without notice to revise the content of our Website (including the Employment Recruitment Services offered by us) and these terms and conditions. Any changes to these terms and conditions will be posted on our Website and by continuing to use our Website following any such change you will signify that you agree to be bound by the revised terms and conditions of use. We may at any time modify change or discontinue all or part of the Website, charge, modify or waive any fees required to use our Website

3. Before you agree that we will provide Employment Recruitment Services to you please read the terms and conditions. If you have questions concerning them please ask before entering into a contract with us.

4. Registration Obligations
This Website is available for use by individuals searching for employment and in consideration of your use of the Website, you agree to:

4.1 provide true, accurate, current and complete information about yourself when filling out our registration form; and

4.2 maintain and promptly update your Candidate Profile to keep it true, accurate, current and complete. If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration.

4.3 Your Candidate Profile uploaded to our Website or any other information about yourself submitted through our Website is subject to this agreement. By registering with our Website you are requesting and authorising us to store and make the information you have uploaded available to all and any Client registered with us. By uploading your information to our Website you agree that your information will remain on our Website until you contact us to request its removal. You acknowledge and agree that you may be contacted by any Client registered with us at any time and that your Candidate Profile will remain on our Website until you request its removal


5. General points and limitations
5.1. Before we provide the Employment Recruitment Services, you should consider:
5.1.1. making a back up of any data you have only on the computer or storage device which is to be the subject of, or to be used in the performance of, the Employment Recruitment Services;
5.1.2. making a written note of any configuration settings, user names, passwords or information stored on any equipment or computers;
5.1.3. downloading and installing:
5.1.3.1. any available security and protection updates for the operating system you use; and
5.1.3.2. any available updates to virus checking and other computer protection software you use.

5.2 When you attempt to transmit an application or a message to a Client through our Website, you agree and acknowledge that this is without warranty and we do not guarantee that a Client will receive, access, read or respond, or that there will be no mistake in the message or data during the transmission process. We may notify you if this occurs but you agree and acknowledge that we do not have any obligation to do so.

5.3 You agree and acknowledge that:
5.3.1 we are not responsible in any way for Client job postings, their application process, any Client messages received by you, job criteria, testing or assessments or any action or inaction by the Client;
5.3.2 we do not warrant or guarantee the receipt by a Client of any application you may make;
5.3.3 we do not verify the contact information provided by the Client.
5.3.4 we do not guarantee or in any way check or verify the identity of a Client or any individual working for a Client;
5.3.5 we do not check or verify the validity of a job offer;
5.3.6 it is your responsibility to check and verify the identity of the client or any job offer. We recommend this is done before any action is taken in relation to any current employment you may have.
5.3.7 that by using our Website you may come into contact with content that you find harmful, offensive, rude, threatening, indecent or objectionable including but not limited to explicit language and offensive material. You acknowledge and agree we have no liability with respect to such content.

If you do not agree to the limitations we have imposed when contacting the Client through our Website, please find an alternative way to contact the Client through a medium other than our Website.

5.4 You agree not to upload or transmit as a message anything containing official identification information (yours or another’s), such as national insurance number, passport number, driver’s licence number or any similar information to identify you. Posting such information may lead to identity theft and you agree and acknowledge that we have no obligation to remove such information if uploaded by you and we have no responsibly or liability for any such adverse consequences as a result of your breach of the terms of this agreement

6. Liability
6.1 You agree that we act merely as an introductory service providing a forum allowing you and Clients to come together

6.2 We will make available through our Website certain job listings and other job-related contents, including links to third party-websites, through our Website. The job listings are created and provided by third parties/the Client. We do not exercise any control over the Client or the job listings which you acknowledge. Furthermore, we do not screen any job listing nor do we have an obligation to do so. We are not obligated to include any job listing in your search results and we may exclude or remove any job listing at our sole and absolute discretion at any time for any or no reason.

6.3 We cannot confirm the accuracy or completeness of any job listing or any other information submitted by a Client. We assume no responsibility and disclaim all liability for the content, accuracy, legality, reliability or availability of an job listing.

6.4 Your acceptance of these terms and conditions acts as a general release of us (and all of its officers, directors, agents and employees) from any liability for any claims, loss or damages (both direct and indirect, including loss of profits, goodwill, business opportunity wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever)) arising out of or in any way connected to your use of the Employment Recruitment Services and our Website and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to the Website and your use of it to the maximum extent permitted by law.

6.5 In addition, we make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information and related graphics published on our Website. From time to time our Website may contain technical inaccuracies or typographical errors. All liability of us howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.

6.6Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. Our liability to compensate you for any loss or damage (in the case of loss or damage other than death or personal injury) is limited to a reasonable amount having regard to such factors as whether the damage was due to a negligent act or omission by us. Our liability for death or personal injury is also subject to certain limitations which are set in the clause below.

6.7 We will compensate you for any loss or damage you may suffer if we fail to carry out duties imposed on us by law (including if we cause death or personal injury to you by our negligence) unless that failure is attributable to:
6.7.1 your own fault;
6.7.2 a third party unconnected with the provision of Employment Recruitment Services under this contract; or
6.7.3 events which we could not have foreseen or forestalled even if we had taken all reasonable care.

6.8 Otherwise, you agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Website.

6.9 You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of the Website.

7 Contacting each other
7.1 If you wish to send us any notice or letter then it needs to be sent to info@pickofthepeople.com. If we wish to send you a letter or notice we will use the address you have provided.

8 Disputes
8.1 If you are unhappy with the Employment Recruitment Services we provide we hope you will discuss any problems or issues with us first. If you wish you may, at any time, take court proceedings. If so, you must do so within the courts of England and Wales. This contract is governed and construed by the law of England and Wales.

8.2 Some of the Employment Recruitment Services offered through the Website may not be lawful or may otherwise not be permitted in certain countries outside the United Kingdom. If you attempt to order, receive, purchase or otherwise benefit from any such Employment Recruitment Services, we do not accept any liability for any losses suffered by you in using the Website which you would not have suffered had you been accessing the Website as a United Kingdom resident (including as a result of us being prevented from dealing with any application or enquiry by any law, regulation or other ruling applicable in any country).

9 Interruptions and Omissions in Service
9.1 We do not accept any liability arising from any errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Website (or any particular part of it) or to provide the service offered on the Website. We may vary the specification of this site from time to time without notice.


10 Links to other Sites
10.1 We do not accept any responsibility for or liability in respect of the content of those sites, the owners of which do not necessarily have any connection, commercial or otherwise, with us. Using automatic links to gain access to such sites is entirely at your own risk.

11 Information on this Site
11.1 Whilst we make every effort to ensure that the information on our Website is accurate and complete, some of the information is supplied to us by third parties and we are not able to check the accuracy or completeness of that information. We do not accept any liability arising from any inaccuracy or omission in any of the information on our Website or any liability in respect of information on the Website supplied by you, any other website user or any other person.

12 Your Use of this Site
12.1 You may only use the Website for lawful purposes when seeking employment.

12.2 You understand that all data, text, software, music, sound, photographs, graphics, video, messages or other materials (content), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom the content originated. This means that you and the Client, and not us, are entirely responsible for all content that is uploaded, posted or emailed via the Website. We do not control the content posted and therefore do not guarantee the accuracy, integrity or quality of the content. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction.

12.3 You agree not to attempt to decipher, disassemble or modify any of the software, coding or information comprised in the Website.

12.4 You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to the Website

12.6.10 disrupt the normal flow of dialogue, cause a screen to ‘scroll’ faster than other Users, or otherwise act in a manner that negatively affects other Users’ ability to engage to use the Website; or

12.6.11 violate any applicable national or international laws or regulations.

12.6.12 post anything that encourages or causes spamming or flooding

12.7 You agree not to crawl, scrape, trade, duplicate, reproduce, copy, sell, or resell the Website for any purpose

13 Information Submitted by You
13.1 We will use information supplied by you (including, without limitation, sensitive personal data) to aid the recruitment process and associated administrative functions. This involves us, amongst other things, processing and storing your information (including, without limitation, sensitive personal data) and passing or making available online such information to Clients (or third parties assisting them in their recruitment process) which may be posted directly onto the Website.

13.2 By registering and using the Website, you consent to the transfer of any submitted information to third parties within and without the EEA.

14 Content Rights
14.1 The rights in material on the Website are protected by international copyright, software and trademark laws and you agree to use the Website in a way which does not infringe these rights. You may copy material on the Website for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

15 Security and Passwords
15.1 In order to register with the Website and to sign in when you visit the Website, you will need to use a user name and password. You are solely responsible in all respects for all use of and for protecting the security confidentiality and proper use of your email verification number and password which may be given to you or selected by you for use on the Website which should be kept confidential at all times and not disclosed to any other person. You must immediately notify us of any unauthorised use of them or any other breach of security regarding the Employment Recruitment Services. We accept no liability for any unauthorised or improper use or disclosure of any password.
15.2 We use third party services to secure and protect your credit card information and assist your experience. However, any losses incurred or sustained by you in transmitting information shall be borne solely and exclusively by you and in no event shall any such losses in whole or in part be borne by Us. If you are using a public computer, you must sign out when you have finished


16 Licence
16.1 You grant to us a worldwide, royalty-free, irrevocable, non-exclusive licence (including the right to sub-license) to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform or display any content (in whole or part) you upload, post or email and/or to incorporate such content in other works in any form, media or technology now known or developed.


17 Termination
17.1 We may terminate your registration and/or deny you access to the Website or any part of it (including any services, goods or information available on or through the Website) at any time in our absolute discretion and without any explanation or notification.
17.2 You will only have the right to cancel within 14 days, starting on the day after you complete your registration

18 Changes to Terms and Conditions and Invalidity
18.1 These terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use the Website following any amendment.

18.2 If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
